Effective January 1, 2015 there were changes in the recording fees and mortgage registration tax for the Register of Deeds offices across the state (K.S.A. 28-115). The changes are outlined as follows:
*There is no longer a Mortgage Registration Tax .
*Recording fees - see the Fee Schedule on our website.
*A cap on recording fees for mortgages of $75,000 or less has been set at $125 provided the following requirements are met:
- The mortgage must apply to a single family residence
- The residence must be the principal residence of the mortgagor
- The mortgage must be $75,000 or LESS
An affidavit provided by the SUBMITTER must accompany the mortgage verifying that the mortgage meets the above requirements or full recording fees will be collected. It is NOT the responsibility of this office to determine if a mortgage qualifies for the recording cap.
- Affidavits concerning mortgages $75,000 or less become a part of the document and recording fees will be collected for these affidavits.
Fees will be based on the date that the documents are received in our office, not the date the documents are executed.
